COMPLAINTS/GRIEVANCES

The University as a community strives to be inclusive and respectful to all its members. However, there may be times when you feel you have been unfairly judged or treated by another member of this community. The following information is intended to give a brief overview of some of the avenues a person can take if he/she feels discrimination, or another injustice, has occured.

Students who feel they have not been treated fairly on campus have a variety of support systems to address this behavior. Examples of these systems include individual academic departments/college grievance procedures, the Conflict Resolution and Student Conduct Services and the Equal Opportunity Office.

Each academic department/college has specific guidelines as to how to begin the process for addressing grievous behavior. Contact the department office or office of the dean of the college for more information.

The Conflict Resolution and Student Conduct Services office provides guidance in resolving conflicts between students as well as between student and system. They are located in 202 Lory Student Center, (970) 491-7165.

The Equal Opportunity Office investigates and resolves behavior that is related to discriminatory infractions related to specific mandates, including those affecting individuals with disabilities. This office is located in 101 Student Services, (970) 491-5836.

Normal grievance procedures (through the Equal Opportunity Office) will involve an investigation into the behavior, often informally, to see if a resolution can be determined. If not, the process may continue to a more formal level, with options varying from a formal (internal) hearing to a complaint with the Civil Rights Office or to actual court proceedings. Pursuing any outside procedure, however, precludes a formal hearing process.

Students who feel they have been treated unfairly by any RDS staff member are encouraged to contact the RDS director to discuss the situation. Any exceptions to any of the RDS policies can only be granted by the RDS director who will take into account a student's particular circumstance as well as the constraints of the office operations. Exceptions will be considered just that - exception to the policies on a one time basis only - not as setting precedent for any other situation or student.

Because the university is mandated by non-discrimination statutes, if a student feels he/she has been discriminated against due to the presense of a disability on campus, a student should first contact the RDS office so that some preliminary advocacy can be implemented to see if that will address the issue. If RDS efforts do not, or cannot, solve the problem, the student may be advised to contact another entity on campus, including the Equal Opportunity Office, as appropriate to the situation.
